Well, the big debate today seems to be whether this is a true story or not. Courthousenews.com has been around for over 10 years so I’m not sure how this story could NOT be true…unless it was faked.
Here’s the story and the link. If you really aren’t sure, here is the actual court document. Looks like things could get pretty hairy over at DP.
You decide…
“eBay Sues Alleged ‘Cookie Stuffers’
SAN FRANCISCO (CN) - Three men defrauded eBay in a “cookie stuffing” scheme that made it appear the men’s companies should be paid commissions, eBay claims in Federal Court. It sued Shawn Hogan and Digital Point Solutions, Todd Dunning and Kessler’s Flying Circus, and Brian Dunning and Thunderwood Holdings.
eBay says the men devised software programs that, “unbeknownst to the [computer] user, redirected the user’s computer to the eBay Web site without the user actually clicking on an eBay advertisement link, or even becoming aware that they had left the page they were previously viewing. As a result, the eBay site would be prompted to drop an eBay cookie on the user’s computer even though the user never clicked on an eBay advertisement or even realized that their computer had ever visited the eBay site.”
The complaint continues: “once the cookie was stuffed on the user’s computer by one or more of the defendant’s any future revenue actions initiated by that user when the user later visited eBay intentionally, and not as a result of any advertisement places by defendants, appeared to be eligible for commissions payable to one of the defendants”.
eBay claims the defendants also used deceptive means to prevent it from discovering the fraud, and to conceal it. eBay demands compensatory, treble and punitive damages. It is represented by David Eberhart with O’Melveny & Myers.”

Bad boy Shawn, got caught with your hand in the “Cookie Jar”. Actually I think this kind of thing goes on a lot on lots of different scales from large to small. Ebay knows if they sue shawn it will get huge press and have the effect they seek of putting everyone who is thinking of such trickery on notice.

Yep, it sure looks to be true. Ebay probably didn’t suffer as much as other affiliates who would have gotten the commission, though.

This is very interesting. This exact type of thing is happening all around the Internet, not just on eBay. I am intrigued to see what the final actions are against the 3 companies.

Now that’s something everyone should be aware of, these guys are going to spoil the web for us all. That is why regulations are enacted. This is something that should not happen again.

I can’t say that I’m surprized to see this. It has been known for sometime now that digitalpoint owners are more than a bit shadey to say the least. Its sad though that these idiots have to ruin it for the honest and good people.
